NATIONAL badminton player Muhammad Roslin Hashim, who is embroiled in a bitter divorce case, admitted that he never had *** with his wife Faizah Mohammad during their 12-day marriage.

Harian Metro! reported that Muhammad Roslin was willing to swear on his admission that he had never touched Faizah when challenged by her lawyer Musa Awang at the Syariah Court in Petaling Jaya.

Reporters were then asked to leave the courtroom after Muhammad Roslin willingly agreed to swear.

Answering Musa’s questions, Muhammad Roslin said he was sane and aware when he pronounced talak (intention to divorce).

When asked about the reason to divorce, he replied: “Not compatible.”

Faizah previously testified in court that she and Muhammad Roslin had consummated their marriage before he pronounced talak.

On Tuesday, the Kuala Lumpur Syariah High Court rejected Muhammad Roslin’s application for an injunction to stop Faizah and her brother Zulkifli Mohammad from giving statements to the press regarding the divorce.

Syariah judge Jamil Ahmad set May 12 to decide on the case.

Guys n gals,

Many of you are of the opinion that issues like religion, race, income, politics are taboo in this forum. I read statements from some ranging from 'I am here in this forum to relax and discuss badminton' to 'this forum should only be about badminton related matters'.

Roslin? Yes, he is a pro shuttler. But what has his unfortunate divorce gotta do in this Professional Players section? Is his divorce related to badminton matters?? This is the Professional Players section and lets talk about the professional players not their wives, mothers, papas, grandmothers, uncles, aunties, sister in laws, cousins, neighbours, sisters, brothers, brothers' neighbours or whatsoever.

Look Roslin is going through some hard times. And I believe he dont need nor deserved our unadulterated opinion or say about his marriage. Lets not drag his divorce through mud.

You are wrong. Whether Roslin is a celebrity or not, his family matters should be respected, period.

It is simply hypocritical if on one hand we say sensitive issues like race, religion, *** etc should be respected and not discussed and yet we happily participate in Roslin's family matters.

Of course, hauge. I don't think it's wrong to discuss pro players' private life. Or else, get me back when i discuss on kkk's.

In Roslin's case, of course it get sensitive when his marital problems being discussed. I prefer him as a baddy player, not yet a celebrity. However, it is as simple as - take it or leave it. You can choose to discuss, also, to not discuss. peace yea.

Divorce is a painful experience and become public knowledge makes it doubly difficult...I am sorry to make light of Roslin's plight in my previous posts, I would take it back. In a way, the split occurs early and there is no kids involved...that may be a blessing.

I think it is a bit bizarre...interesting story though...

Actually ah, the story already appeared some time ago in Harian Metro & it seems TV3 news also covered it. Metro also interviewed the ex-wife to get her side of the story, there're photos of her as well (since someone asked). Those who want to read for yourself can do your own search, but it's nothing scandalous as in Roslin and the ex didnt have an affair or that kinda stuff.

But since it's in malay (troublesome to translate) & just sensational news, some of us who knew didnt post it. It was not clear whether Roslin himself announced to the press or reporters cornered him & asked but Roslin was the one who said it 1st, later followed by a statement from the ex-wife.

And it was a talak satu divorce, not talak tiga, muslim members will know better what this means.

Since someone mentioned about the ex wife, she's quite pretty looking malay lady with fair complexion. I do hope both of them & their families are able to go thru this tough time & move on.

For those Roslin fans who're concerned, Roslin stated to the press that the divorce did not deter him from subject of marriage or the idea of marrying again. On Baddy, I remember Roslin did say he wanted to retire end of 2009.

Talak is an Arabic word meaning "to release" or "to divorce". Under the Muslim law, talak means "to untie the matrimonial knot by articulating a word denoting divorce."

It's taken from http://app.syariahcourt.gov.sg/syariah/front-end/TypeOfDivorce_Talak_E.aspx
There are explanation of the 6 classications of Talak there.

Court orders trial for Roslin Hashim’s claim for losses from former wife

January 26, 2010, Tuesday

KUALA LUMPUR: National badminton player Roslin Hashim’s ex-wife yesterday failed in her bid to set aside the shuttler’s claim of RM53,460 in losses from their 12-day marriage after the Syariah High Court here dismissed her preliminary objection.

In handing down his decision, judge Mohd Radzi Abd Latif ordered that the case be tried and fixed March 23 and 24 for the hearing which would be held in a closed-court.

On Aug 12 last year, Roslin or Muhammad Roslin Hashim, 34, filed a suit against Faizah claiming for losses he allegedly incurred during their marriage.

The couple married on Jan 30, 2009 and divorced 12 days later.

In his statement of claim, Roslin, who was represented by lawyer Roslizam Rahim, stated that the claims included for purchase of rings and expenses incurred during the engagement and wedding ceremonies, including for rental of canopies, video and hotel rooms.

Faizah filed the preliminary objection on Oct 21 last year on grounds that the claims were ridiculous and undignified.

At yesterday’s hearing, lawyer Mohd Amir Nazli Hussin, who represented Faizah, submitted that the case, if tried, could embarrass both parties as it would involve their sexual relations during their marriage.

“Roslin claimed that he divorced Faizah because he could not get sexual satisfaction from her. Therefore, if this claim is allowed and all the facts are submitted, they can embarrass both parties,” he added.

He said the action by Roslin could also set culture for former husbands to file for losses from their ex-wives.

“Not only is the defendant (Faizah) made a virgin divorcee after 12 days of marriage, but she is also being blamed and burdened with this undignified claim,” added Mohd Amir.

He also said that the court had no jurisdiction to hear and decide on Roslin’s claim under section 46 of the Administration of Islamic Law (Federal Territories) Act 1993.

However, Roslizam submitted that the case could be used as a source of reference for others.

In refuting that the grounds for the divorce given by his client was petty, Roslizam said Roslin suffered because Faizah could not give him sexual satisfaction.

'Game over' goes to the courts

Honeymah Dylyani
Saturday, 13 February 2010 14:14

ROSLIN Hashim has had his ups and downs in the national and world badminton rankings, and often when his performance is not up to mark his fans will forgive him and give him another chance to move up the ladder.

However, when he got married in January last year, it was ‘game over’ in just 12 days.

After less than two weeks of marriage, the 34-year-old badminton ace shocked the nation by saying he was divorcing his virgin bride, Faizah Mohamad, 32.

This time, the fans have no say in his ‘lost match’ but could only speculate on what might have gone wrong. While many celebrity marriages are known to be shortlived affairs, this must be a record!

The matter has gone to the courts and the issue is expected to be one of the most sensational cases, aside the ongoing Anwar Ibrahim Sodomy II case.

'Can of worms'

“As everyone knows, when you go to the court, you will certainly open a can of worms.

“So my advice to both parties is: think carefully before going further,” Jamaah Islah Malaysia (JIM) president Zaid Kamaruddin told the Malaysian Mirror.

“Jodoh (the meeting of two persons for the purpose of marriage) Is ordained by Allah.

“They (the couple) could have avoided getting into this mess if they had first tried to get to know each other before marriage, during their betrothed period.

“Things would have been easier for them then. Now, their only solution is to go to court.”

Zaid said Islam discourages matters of humiliation to be avoided in public, to keep the dignity of both parties intact.

For a start, he suggested, both sides should discuss the matter together and, if the issue cannot still be resolved, they should each have a takhim (representative) who they trust to talk things out on their behalf.

Then, whatever is discussed should be appropriately followed-up by the man and woman in the dispute.

“Unfortunately, in Roslin’s case, he prefers to air his grievance to the Syariah court, so both parties have to bear the consequences.”

A Syariah lawyer who declined to be named said: “From the start Roslin and Faizah had not had any sexual contact, so it is not accurate that he did not get any sexual satisfaction from the marriage.

“One of the issues here is tiada langsung (none at all), and a marriage should come with sexual contact. If this does not happen, the marriage is void.

“In a non-consumated marriage, the ex-wife will not have to go on edah (the period covering three menses after a divorce). She can marry anyone she likes even the next day (after divorce).

“What happened was, the Syariah High Court has dismissed her (Faizah’s) preliminary objection and this showed that it is under the court jurisdiction to hear the case.”

Embarrassing to both parties

The lawyer agrees that the case, if tried, might embarrass both parties but it is for the court to use its discretion. “Things will go according to the law,” he added.

“Although there’s an argument that Roslin’s case can set a culture for former husbands to file for losses from their ex-wives, it does not matter.

“A man cannot sue his ex- wife without proper reason. But a wife has as much reason to get financial support from her ex-husband, including fasakh (compensation) , harta sepencarian (property acquired on joint income) and financial support for the children.”

At this moment, he said,it is quite difficult to make much comment.

The shortlived marriage between Roslin and Faizah on Jan 30 last year generated controversy after the badminton player confessed to having proclaimed divorce after 12 days of marriage.

The divorce, however, was declared valid by a lower Syariah Court in Petaling Jaya in May.

It ruled that the divorce proclamation, or talak, uttered by Roslin at 10.50pm on Feb 11 last year at the home of Faizah’s parents in Taman Puchong Perdana was clear, made consciously and according to Islamic law.

Syariah judge Jamil Ahmad, was quoted by Malay news portal mStar, as saying that the court’s decision was also based on Roslin’s previous admittance that he never had *** with his wife during their brief marriage.

“The plaintiff (Faizah) is not in her edah period , which means that they cannot reconcile. If they want to be back together, they must remarry,” he said.

Cannot be reconciled

Following this, the court pronounced a bain sughra talak on the couple, which meant that although the husband had proclaimed divorce fewer than three times, they could not be reconciled unless they remarried although the wife might still be in edah.

On Aug 12 last year, Roslin filed a suit against Faizah, claiming for losses he allegedly incurred during their marriage.

The claims were for purchase of rings and expenses incurred during the engagement and wedding ceremonies, including for rental of canopies, video and hotel rooms. The national player’s claims amounted to RM53,460!

She made an objection but a Syariah High Court set it aside, ordering that the case be tried. Syariah High Court judge Mohd Radzi Abdul Latif fixed March 23 and March 24 for the hearing, to be held in a closed-court.

Then, early this month, Faizah filed another application to review the court’s decision in setting aside her preliminary objection.

In her application, Faizah stated that there were oversights and errors by the judge who heard her preliminary objections.

She also said that court had no jurisdiction to hear and decide on Roslin's claim under section 46 of the Administration of Islamic Law (Federal Territories) Act 1993.

The action by Roslin, she said, could also set a culture for former husbands to file for losses from their ex-wives, as well as would cause embarrassment and problems for her and members of her family.

"It involves questions of law, rights, pride and public interest," she added.

A third person in the picture?

In between the court cases, the debates continue on what had happened during the brief marriage and whether it is too much for Roslin to claim damages from his ex-wife?

Among the rumours that had spread was that Roslin was allegadly having an affair with movie producer and director Raja Azmi, the wife of former badminton doubles champion and Roslin’s mentor, Jalami Sidek.

Raja Azmi and Jalani had both slammed the rumours but admitted that they were close to Roslin and had regarded him as a brother. And, admittedly, Roslin had shared some of his ‘intimate’ secrets with the couple.

Raja Azmi and Jalani, who has been married for more than 25 years, had also threatened to take the court those who were spreading the rumours.

Claims of rejection
Notwithstanding this, some bloggers had claimed that Raja Azmi knew the reasons for the divorce and had reportedly confessed on the TV9 progamme, Galaksi, that she was the one who introduced Roslin and Faizah to each other.

It was gossiped that during the period of the marriage, Faizah was having her menstrual cycle and had rejected the amorous overtures made by Roslin. This reportedly slighted him and made him angry to the point of divorcing her.

Roslin himself had been reported as saying that after three days of their marriage, he had begun to have serious thoughts about whether they could make the marriage work.

“I felt that I was not being treated like a husband; there was no respect for me though I still gave her a chance,” he was quoted as saying in one report.

Perhaps, good sense between the pair would prevail and the issue could be amicably settled without being a lengthy scandal. Roslin abd Fauizah should just move on with life. – Malaysian Mirror

'Roslin went to hotel with another woman'

http://www.dailychilli.com/images/stories/2010/08/16_18/roslin.jpg
Roslin Hashim

The wife of former national badminton player Roslin Hashim told the lower Syariah Court in Kuala Lumpur their divorce was sparked off by Roslin going to a hotel to be with another woman.
Norhayati Othman, who testified at the Gombak Timur lower Syariah Court on Wednesday, claimed that her husband and Raja Azmi Raja Sulaiman, the wife of former national badminton player Jailani Sidek, checked into a hotel here on Aug 7.
“They checked into a room which was registered under Raja Azmi’s name,” said the 38-year-old, adding that she had gone to the hotel in Jalan Ampang with her mother and two younger brothers to look for Roslin, 35.
Norhayati, who is the National Film Development Corporation’s marketing director, said Jailani was also there at that time and had tried to stop her and her family by calling Roslin to get out of the room.
“When we entered the room, only Raja Azmi was there. I then asked Jailani to call Roslin to come back. After an argument, Roslin uttered the divorce proclamation by saying ‘I cerai you lah’ (I divorce you),” she said.
Wednesday was the first day of hearing for the case filed by Norhayati, who is seeking to validate the divorce proclamation.
Roslin, who later took the stand, claimed that he was pressured to utter the proclamation because the situation was very tense and his wife had “forced” him.
He denied being in the same hotel room with Raja Azmi, 51, whom he said had asked him to accompany her to register the room.
“She had permission from her husband, Jailani (to register the room with me). I went to park my car while she checked in alone,” said Roslin, who married Norhayati on July 9.
He said he was very angry that his wife had confronted him in the hotel, together with reporters and Federal Territory Religious Affairs Department officers.
“If she suspected that I was having an affair with Raja Azmi, she should have talked to me personally,” Roslin added.
Lawyer Zulqarnain Lukman acted for Norhayati while counsel Roslizam Rahim represented Roslin.
The former national player from Kelantan married Norhayati, his second wife, after meeting her less than five months ago.
Roslin’s first marriage, to Faizah Mohamad, lasted only 12 days.
On Aug 12, he filed a RM53,450 suit against Faizah for losses he allegedly incurred during their engagement and wedding ceremonies.

Roslin divorced again

By NURBAITI HAMDAN
nurbaiti@thestar.com.my

KUALA LUMPUR: Former national shuttler Roslin Hashim is now a divorced man, for the second time.
The Gombak Timur lower Syariah Court here ruled that a divorce proclamation uttered by the 35-year-old athlete was a clear and valid proclamation intended for his ex-wife Norhayati Othman, 38.
Syarie judge Wan Mahyuddin Wah Muhammad ruled that the couple was officially divorced with talak satu (reconcilable divorce) and ordered the marriage certificate to be annulled.
“The court sees this divorce as something sad and shocking as it ended within such a short time.
“Furthermore, it started in a hotel (Roslin and Norhayati hosted their wedding reception at Flamingo Hotel in Ampang) and ended in a hotel,” he said.
Roslin was said to have uttered the words “I cerai you lah” (I divorce you) to Norhayati, who is the National Film Development Corp*oration marketing director, at room 533, Corus Hotel, here on Aug 7.
At the time, they had been married for about a month.
The divorce attracted media attention as it implicated film producer Raja Azmi Raja Sulaiman, who is married to former national badminton player Jailani Sidek.
Norhayati, who applied to have the divorce validated, testified that their arguments which resulted in the divorce proclamation came when Roslin had gone to a hotel room to be with another woman.
Speaking to reporters later, Roslin said he was relieved that the case was over.
“When I got married, of course I wanted it to last a lifetime but this is the course of life that God wants me to go through,” he said, adding that he had not given up on marriage despite the marital failures.
As Roslin was speaking to the media, a man came over and dropped off two huge bags near him.
Norhayati, who stood near the court door and was about to leave, was heard saying: “You can have your bags.”
Roslin and Norhayati were married on July 9 at Flamingo Hotel after a whirlwind courtship of almost five months.
This is the second marriage for Roslin. His first marriage to Faizah Mohamad, 32, on Jan 30 last year lasted only 12 days.
