    Hi all,

I recently purchase a fake MP-100 on Ebay. I have filled a clam through Paypal but I though you may like to see what the communication with the seller has been. He is listed on Bluejeff's fraudulent seller list, bidyesbid, but I did not see it in time
as of this post I have received no new communication from Tony(bidyesbid)

    Hi Tony,

I received the raquet today. That was unbelievably fast shipping. Thank

you. Great job stringing it as well.

I do, however, have some concerns about the raquet's authenticity:

1- The serial # is not etched into the raquet. I have other Yonex raquets,

even another Musclepower, and the serial #'s are etched into the cap just

above the grip. Yonex Canada confirms that the serial # should be etched

    into it.

2-The color appears to be off. I was looking at an identical raquet on

Tuesday and it was red. The one you sent me has a slightly orange tinge to

    it.

3-The "Ultimum TI+High Modulus Graphite" graphic is "smudged". The U and

the L of Ultimum are unreadable and all you can see is "Timum" with a few

marks in front of the "t". I believe Yonex quality control would have

picked that up prior to shipment.

4-The Yonex name and the "YY" symbol on the cap on top of the grip are not

aligned with the shaft. That is, they are slightly askew.

5-Yonex Japan's site lists available weight/grip size as being:

    WEIGHT / GRIP SIZE 3U(85-89g) / G4,5

    2U(90-94g) / G3,4,5

    http://www.yonex.co.jp/intl/badminton/products/muscle.html

Also, I have not been able to locate a retailer that is offering this raquet

in a grip size lower than G3.

The raquet you sold me is listed as 4U/G2.

    What is the "PBSI" graphic?

    Your item description states:

You are bidding on Brand New Yonex Muscle Power 100...

Tony, Can you confirm that this raquet is authentic Yonex?

    Colin

    the reply was:

    Hi Colin,

Firstly I'm sorry for made you this misapprehension.

Actually the racket I'm selling is OEM version, also that is why the price just so cheap, but we promise that the items have high quality and good shape and looking good. I think you know that the retail version of Yonex RACKET is 100GBP or more for one item. but you only paid me 47.3GBP( included shipping cost and insurance).I think buy my item is cost-efficient choice.

just explain you the string is authentic yonex products.

if any seller who selling items on ebay same as my price and tell you that the rackets are same as retail version, he(she) 100% is a swindler.because it is mission impossible! ^_^

    Sincerely,

    Tony

    more from Tony

    Hi Tony,

thanks for your prompt reply. I appreciate it.

What does OEM raquet mean? And why do you not mention that in your

description on Ebay. Is it manufactured by Yonex as your description claims

it to be? keep in mind your description from Ebay reads as follows:

You are bidding on Brand New Yonex Muscle Power 100 unstrung badminton

racket. 100% excellent quality!! This item has never been used and it has an

original plastic wrapped on the handle. The retail price is over 190USD.

Check out my other auctions. I would like to combine shipping if you order

more than one items. We have other rackets in stock, please feel free to ask

    for details.

    Auction included:

    1. Brand New Yonex Muscle Power 100 unstrung badminton racket. We can help

string the racket with Yonex BG-65 string(3.5GBP) or Yonex BG-65Ti

string(4.5GBP). If you buy more than one racket, we will free the

    string(BG-65) as a gift.

I know the string is authentic, that was never in question. My point is

that the raquet I have received does not match the description. You

misrepresented the item and you're admitting to it in your reply. I didn't

say I don't like the raquet, 'it's just not what you claim it to be and for

that I believe you should refund my money, $105 Canadian. if you state in

your description that it is an OEM version of a Yonex MusclePower 100 then

    there wouldn't be a problem.

I will await your response and then based on your response I will compose my

    feedback for the item.

    Hi Colin,

    thanks for your reply.

Actually You paid me 47.3GBP for the racket, but I have paid 17.8GBP to DHL for shipping cost, I never wanna charge u money according retail version, If I charged u 100GBP then send you an OEM racket, you can consider I'm a lier. but I only charged u 47.3 - 17.8 = 29.5GBP.

How can you get a retail version racket using 29.5GBP? I think it is common sense.

In order to don't make u unhappy for this matter, there are two solutions for your reference:

    1. I'd Like to refund u 8GBP as gift.it is almost all profit for this deal.

    2. You could send back the racket then I refund you 29.5GBP when I received the raceket( I have paid 17.8GBP to DHL you know.)

though it is a OEM racket, but I promise you that the racket have high quality, it is very cost-efficient.

looking forward to hearing from u.

    Sincerely,

    Tony

    Still more from Tony...

    Tony, Tony, Tony...

It doesn't matter that I know you can't get a "real" MP100 for $25GBP. Your

listing clearly states, in plain English that it is authentic. Now you are

    saying it is not.

You don't seem to understand that you did not say that the Item is OEM in

the description which apparently is a Chinese word for fake.

I appreciate your offer to refund $8 GPB, sure go right ahead. send it to

    grou_mou@hotmail.com.

    Bottom line is:

Your item is not authentic Yonex as you claim it to be as per your own

description and you admit to it!!

    My feedback will read:

"Fast shipping, great stringing, FAKE RACKET-Item listed as authentic,

actually OEM-Chinese for FAKE, In correspondence Tony admits to lying about

    item description."

Feedback will be of course negative and I will report you to eBay for

    misrepresenting items and PayPal.

And for the record, I paid 17.8GBP to DHL, not you. I paid for the

    shipping.

    Good day to you sir,

    Colin Muise

    His Reply:

    Hi Colin,

Please don't angry, I just tell you my opinion, If u ask me if the racket is retail version or not, I 100% will tell you the truth.

any way, I 'd like refund you full money (47.3GBP) even I will lost lots money for this dealing. but you should send me back the racket first.

Actually I will not refund u even 8GBP if you decide to leave me negative feedback.I hope we could leave positive feedback for each other Since I never wanna deceive you once you purchased my racket at the very start.

look forward to hearing from u soon.

    Tony,

    My reply
    Tony,

According to eBay rules, you should have left me positive feedback when I

paid. You have no reason to leave me negative feedback.

Keep in mind you clearly admit to misrepresenting the item on eBay.

If you want the raquet back, I will send it back to you. You must send me

the additional shipping cost. I will accept $17.8GBP on top of the $47.3

GBP that I paid. Return shipping is your responsibility.

So, you agree to send my paypal a/c ,grou_mou@hotmail.com, a total of $65.1

GBP. I agree to send you back the raquet and not leave negative feedback.

I will assure you that I will keep my end of this bargain, all you are

required to do is send the $65.1 GBP to my paypal a/c. grou_mou@hotmail.com

    Awaiting your reply,

    Colin Muise

    The Last from Tony

    Tony, Tony, Tony,

Do you know what the word "misrepresented" means? A simple definition reads:

    having an intended meaning altered.

the intended meaning as per your description is "brand new Yonex". Look at the subject line of this email. You have now altered the description and told me that it is an OEM raquet. I have no doubt that the raquet is of the finest OEM quality available. That isn't the point. You seem to have trouble understanding what the point is. It is as follows:

YOU SOLD ME SOMETHING THAT YOU SAID WAS AUTHENTIC YONEX AS PER THE ITEM DESCRIPTION ON eBay!!!!!

IT IS NOT AUTHENTIC YONEX, YOU HAVE STATED AS SUCH AND ADMITTED TO LYING IN THE DESCRIPTION!!!

Had you stated that the racket is an OEM in your description, we would not be having this conversation. I would be very happy with the raquet, but because you didn't I'm very upset.

Because of the fact that you misrepresented the item, your arguments are not valid. You have no leg to stand on. Ebay will agree with me.

If you want me to leave feedback right away, I will and you know how it will read.

As per your offer: NO DEAL!!!

You refund my money, I'll even ship it back to you @ my expense. $47.3 GBP to my paypal a/c, grou_mou@hotmail.com

    This happens first.

I understand how late it is there. by the time you wake up I will be out of the office. I will be very honest with you. If you don't refund my money by the time I get back in on Monday, March 21. I will:

1-Leave the negative feedback as per my previous Email

    2-Report you to Ebay

    3-Report you to paypal

    4-Report you to Yonex

I do not want to go this route. I know that you want to protect your eBay rating. I hope that you will do the right thing.

    Colin Muise

    His reply was:
    Hi Colin,

According to ebay rules, You should leave me positive feedback too when you received the item .you never asked me before you purchase it! unfortunately you have no common sense for the price of yonex racket.

anyway, I also would like refund you the money, but you should do something first:

1.leave me positive feedback.also I will do it too.

2.send me back the racket, you must promise me that the racket was never used and same as I sent to u.

I think you should not send me the racket with DHL, you could send the item via Canada post, I think the shipping cost will be cheaper more than DHL( around 5 GBP to China),actually you could ask them for tetail.

NO doubt I will lost a lot of money for this dealing if I refund you the money, BUT i must let you know that I NEVER wanna deceive anyone!

time is now 1:00 am , I should go to sleep right now. I will reply you tomorrow

    my reply

    Tony,

    No, I'm not doing that.

If you really hate disputing with me then the solution is simple, refund my money. Send the total amount, $47.8GBP to my hotmail a/c, grou_mou@hotmail.com. You have until end of my day tomorrow. I am giving you a way out of this, please take it.

You haven't shown me your full sincerity yet. If you had, then I'd have all of my money back.

This will be my last contact to you regarding this matter, I leave it all in your hands.

The next people to contact you about this will be eBay, PayPal and/or Yonex.

    The choice is yours.

Fool me once, shame on you.

Fool me twice, shame on me.

    Colin Muise

    Yet another from Tony

Apparently my last email piqued his interest. He replied with:

I have said that you should send me back the racket then I will refund you the money, do you understand my meaning?

who can promises that you must refund me the rackets after I refunded you the money? I really don't think you will do it since you Never promise me that you'd like send back the racket.

I will provide all emails to paypal and explain them may u wanna ask me refund you the money and don't wanna send me back the racket.

    I replied with:
    your replies puzzle me Tony.

I have said that i will send you the racket back once you refund my money. I understand that.

I also understand that, based on your actions, you are not a truthful person,

I understand that you state that you sell things which are you say real.

Now I understand that they are not.

I will not send you the racket unless you refund my money.

I understand your hesitation to refund my money without the racket. I have said that I will do that. I issued payment right away. I issued a second payment as well. you have no reason not to believe me.

It's not like I'm on eBay selling fake Yonex rackets.

Every one who has left positive feedback for you must not know what a real Yonex racket is. I do.

By all means, share our communication. The way that it works is that they will contact you and then they will contact me. I'll share them as well.

Nah, I don't think you should report the fool. Even if you do, what could happen? He's not gonna go to jail or anything. If you leave a negative feedback, he'll just use a new account, or ignore it.

Try making him understand that he did NOT say that the racquet is fake and he DID decieve you. Make him understand that he did something wrong and he should make the first step to the solution.

What's gonna happen if you report him to ebay and paypal? He get a little online record? lol.....

Deal is too good to be true

I wouldn't waste time with the man. You got fooled once already. At this point, I doubt you will get back your money at all, even if you send the racquet back in full faith. You should just move on and use the racquet. Let that be a lesson to you and all BF'ers who read your predicament.

    did you pay via creditcard?

if you're a good customer and client in good standing, give them a call and tell them whats going on.
they might or might not make it their matter.
if they do, they'll refund you on your losses, and deal with the matter themselves.

    if not, you're outta luck.

in that case, then like cappy mentioned, make the best of your racquet and be more wary next time in online dealings...

    Best case scenario:
you get a chargeback from the credit card company. You get your money back.
credit card company issues charge back to paypal, gets money back.
paypal freezes his account and bank for months to years, gets more than its money back.
seller gets to be one of the many people that gets :eek:ed by paypal.

mmm. Can we bring in the russian mafia now???

Insist that he refund you FIRST before you go and return the racquet. He's just a small arse punk who tries to play in the big leagues with the big boys....

From his letters, he tries to act professional, and tries (may I emphasis tries) to show professionalism in his work... but instead it doesn't.

"Please don't angry, I just tell you my opinion, If u ask me if the racket is retail version or not, I 100% will tell you the truth..." <-- WTH is that... "Please don't angry" BAH HUMBUG....

Not bothered to point out his grammatical errors now....

    Ah well. Go get him!!!!

Actually in these cases... There is a possiblity that he speaks fluent english. Probably better than what we can do. But he's doing the crappy ESL just to play with you :D.

From the start he planned on deceiving someone and acting innocent about it. But sure, if you can get the money back, try everyway.

It's YOUR money, do whatever to get it back. If he won't refund the money, find another way :)

That's why I always use American Express when buying from the internet. Most of the time, AX is on the customers' side. That's also one of the reasons a lot of stores don't accept AX.

    Hmm
One thing, what will happen if you report the Tony Fool to your credit card company or paypal or whatnot? How are they gonna believe you?

You're gonna tell them, that you bought a racquet and he gave you a fake. Without informing you and you got ripped off and stuff.

Now what are they gonna do? 1st they have to really find out if the racquet is fake, who the hell is gonna research about that LOL.
2nd they're gonna see which side they're gonna be on. Yours or Tony's.
3rd.... They will decide if they will even bother being involved in this.

I doubt if paypal or credit card company will do an investigation. 60 GBP to them is nothing. It's cheaper to refund you the money than investigate the case. My experience with AX is that after I called them, they credited my account right away, and deducted from the seller's account, then they were out of it. After that, it's between the seller and buyer of how to return the product. Unless it happens too often, they won't bother to investigate.
