Workers are entitled to public holiday rate
KUALA LUMPUR: Employers must pay workers the rate for public holidays if they work today, said Human Resources Minister Datuk Dr S. Subramaniam.
He said it was up to the employers if they want to work on New Year’s eve, however the government has clearly declared today a public holiday.
“It is the right of each worker to be paid the public holiday rate if he is required to work on a public holiday,” he said at a press conference during an attempt by two girls to set records in weightlifting and sit-ups for the Malaysia Book of Records at MIC headquarters here yesterday.
Dr Subramaniam was responding to the announcement by Prime Minister Datuk Seri Najib Tun Razak who declared Dec 31 a public holiday to celebrate Malaysia’s first-ever win in the Asean Football Federation (AFF) Suzuki Cup championship.
He said workers could lodge complaints with the Manpower Department if their employers fail to give them a holiday or pay them extra.
However, Malaysian Employers Federation executive director Shamsuddin Bardan said under the Employment Act, bosses have the discretion to grant their workers the public holiday or substitute it with another day.
“It is understandable if employers expect their workers to work today because it is not a pre-planned public holiday,” he said.

IF Malaysia wins the next Thomas Cup in future, I'm sure our Prime Minister will declare public holiday for entire nations.
Just that we have not won since 1992
