Maximum 2 years. It's either 0 to 2 years, or 1 to years depending which rule it falls under. The Association can decide to give reduced ban, as already happened in other sports.
But you're assuming LCW's case is exactly the same or similar to Marin Cilic's who didn't undergo stem cell therapy and has no need for dexamethasone to enhance treatment, not to mention what other things we don't know about LCW's.
If it's proven to be intentional, those big cases like Lance Amrstrong, Marion Jones. Unintentional - a lawyer can argue light to normal degree of fault. You know very well the decision on Marin Cilic case, there are other cases as well. Court of Arbitration cant be judging lighter sentence for Cilic and a far heavier sentence for LCW, doesnt add up
pcll99 is merely stating there's a possibility of 2 to 4 years ban for aggravating circumstances. He started by saying it's extremely unlikely.
Cilic is one case among many. LCW may get no ban or he may get 2 years or more. It's too early to say and we know very little about the case at this point. Based on what we have seen, BAM/NSI and the sport ministry have great potential to screw this up big time. This is how LCW can get more than 2 years: (a) Aggravating circumstances under 10.6: (think Razik and deceptive and obstructive conducts to avoid detection or adjudication) (b) multiple violations under 10.7: there are two samples: one for 15 Aug and one for 30 Aug. - 1st Violation: 15 Aug sample by prohibited method during out of competition (ie intramuscular) - 2nd Violation: 30 Aug sample by prohibited method during out of competition - 3rd Violation: 30 Aug sample by prohibited substance during in competition
Of course it's not exactly the same. LCW's case from what it looks at the moment, is stronger, on his side, when compared to Cilic, which was mostly verbal testimony that he took it unintentional, etc, etc. There are other cases as well, there's one Daryl Impey, road cyclist, similar testiomny as Cilic. Wow, he was cleared of all charges. Another was a footballer, forgot the name, less than 1 year ban. All represented by the same lawyer - Mike Morgan
As for no ban, he has to establish "No fault or negligence" under 10.5.1. "No fault or negligence" is defined as follows: LCW will say : "I was under a lot of pain when I agree to the injection on 17 July." or "I slightly sedated, so I don't know what I was going through."
If he really thinks it's extremely unlikely, what for ask for more than 2 years ban to be on the list? No need to rack our brains think abt that part also. Really too anxious lah you all
that's what we think. But there is the 15 Aug sample which BAM ask WADA to test specifically for dexamethasone. We think the 17 July injection caused everything. But WADA and BWF don't care. They have two smoking guns; they will give you at least two charges!! And if BAM say something stupid enough like we inject intramuscular, they will give you a third charge!!! BAM has the potential to screw this up in gigantic proportion.
Dr Ramlan is reputable. BAM, Sport Ministry, as usual the way they do things. If you are Malaysian, look at Auditor General report also know, no surprises. Actually the current Sports Minister is better than his predecessors. Previous 2 to 3 Sports Ministers, would be panicking like nobody's business. Why ? you very anxious LCW get 2 or more years ban? 2 years ban by itself means retire, no need think about the longer ban.
sorry sorry.. To be honest, all options are possible: from no ban to more than 2 years. Fighting an anti-doping violation is the same as a game of badminton. You hire the best people to help you, you do your best yourself, prepare as hard as can and never give up. But there is no way to predict the result. Anyone who say they know what the end result is is kidding you.
BAM pay one. They need preserve their cash cow Since you're here, you can entertain pcl99's kan cheongess. I'm off to zzzzz
I'm sure it's clear who are really the anxious ones, those who pray for 6 months, 3 months or just a reprimand ideally. Like I've said until we know all the facts and circumstances of the case, there's no certainty of the final outcome. What if there's another bombshell out of the blue ? I mean, if we are so sure of LCW's innocence and that he will definitely get a substantially reduced sentence or even get off scot-free, then just limit the choices to 6 months, 3 months and none. The trial (BWF hearing) hasn't even started except that one fact is undeniable, both samples A and B were tested positive for the banned substance, Dexamethasone, in-competition. So anything can still happen, as of now we can only hope for the best. However, bear in mind there's a price to pay for everything in life.
Mike Morgan is quite good. He is one of the few UK lawyers doing anti-doping litigation exclusively. http://www.chambersandpartners.com/11805/648/editorial/1/1#RankedLawyers_Tab
